Terms of Service

This is a starter agreement written to match how LibertyBid actually works today. It has not been reviewed by a lawyer and should be before LibertyBid is opened to the public.

1. What these Terms cover

These Terms of Service ("Terms") govern your access to and use of LibertyBid (the "Platform"), a website that connects homeowners and property owners ("Customers") with local service businesses ("Businesses") for home and property services. By creating an account or otherwise using the Platform, you agree to these Terms. If you don't agree, don't use the Platform.

2. What LibertyBid is — and isn't

LibertyBid is a marketplace that lets Customers post projects and receive private bids from Businesses, and lets Businesses find projects and submit bids. LibertyBid is not a party to any agreement a Customer and Business reach with each other, does not perform, supervise, or guarantee any work, and is not a contractor, licensing body, or insurer.

LibertyBid does not verify business licenses, insurance, or qualifications. A Business's profile may state a license number, insurance status, and years in business, but these are self-reported by the Business and are not independently verified by LibertyBid. Customers are responsible for independently confirming a Business's licensing, insurance, and qualifications before hiring them.

3. Eligibility and accounts

You must be at least 18 years old to create an account. You must provide accurate information and keep your login credentials secure — you're responsible for activity that happens under your account.

When you sign up, you choose one account type — Customer or Business — and that choice determines what you can do on the Platform. Account types cannot be switched; a Business that also wants to post projects as a Customer (or vice versa) needs a separate account with a different email address.

4. Using the Platform as a Customer

  • Posting a project and receiving bids is always free — LibertyBid never charges Customers.
  • Bids you receive on a project are private to you; a Business only ever sees its own bid, never a competitor's.
  • Your project's general area (city, state, ZIP) is visible to Businesses browsing open projects. Your exact street address is not shown to any Business until you accept their bid — see Section 6.
  • You choose whether and when to accept a bid. Accepting a bid is not itself a contract enforced by LibertyBid — it identifies who you've chosen to work with and unlocks direct contact between you and that Business.
  • You can cancel an open project, or cancel after accepting a bid, at any time. A cancelled project can be relisted to collect new bids. A draft project, or an open project with no bids yet, can be deleted permanently.
  • Only you can mark a project complete. Once you do, you may leave a public rating and written review of the Business.

5. Using the Platform as a Business

  • Access to the Platform's marketplace features — browsing and mapping open projects, viewing full job details, submitting bids, messaging, and receiving direct bid requests from Customers — requires an active paid subscription. Current plans, pricing, and included monthly bid allowances are shown on the Pricing page and may change; LibertyBid may also offer a temporary trial or promotional allowance from time to time.
  • LibertyBid does not charge per lead and does not take a commission on any project you win — your subscription is the only fee, regardless of the value of the work.
  • Each bid you submit is private between you and the Customer — you never see another Business's bid on the same project, and no other Business ever sees yours.
  • You can message a Customer once you've submitted a bid on their project. A Customer's exact address and contact information are shared with you only if they accept your bid.
  • Subscription payments are billed and processed by our payment processor, Stripe — see Section 9.

6. Bids and pricing

A bid is an estimate, not a final invoice, based on the information a Customer provided when posting the project — not an in-person inspection. The final price for the work may differ from the bid if an in-person assessment or the work itself reveals conditions that weren't reasonably knowable from the listing. Any change to the price is negotiated directly between the Customer and Business — LibertyBid is not a party to that negotiation and does not mediate, approve, or record it. A Customer is never obligated to accept a higher price than what was bid and accepted; if the two sides can't agree, the Customer can cancel and relist the project.

7. Messaging, reviews, and conduct

Keep communication about a specific project on the Platform until you're ready to coordinate the work directly — the messaging disclaimer shown in every conversation reflects this. You may not use the Platform to harass, defraud, discriminate against, or misuse contact information you've received through it for any purpose unrelated to the project that unlocked it.

Reviews are written by the Customer after a project is marked complete, are public, and may include the Business's public response. Reviews must reflect a real project completed through the Platform and must not contain unlawful, harassing, or knowingly false content.

LibertyBid may review reports of content or conduct that may violate these Terms, and may remove content (including a review) or suspend an account, with or without notice, if it reasonably believes a violation occurred. LibertyBid also applies automated limits on how frequently certain actions (like posting projects, submitting bids, sending messages, or filing reports) can be repeated, to prevent abuse.

8. Payments

Customers are never charged by LibertyBid. Business subscription payments are processed by Stripe, Inc.; LibertyBid does not receive or store your full card number. Subscription terms, billing cycles, and cancellation are managed through your account's billing settings.

9. Content you provide

You retain ownership of the content you post (project descriptions, photos, messages, profile information, reviews). By posting it, you grant LibertyBid a license to store, display, and transmit it as needed to operate the Platform — for example, showing your project to Businesses, or your review on a Business's public profile. You're responsible for making sure you have the right to post whatever you upload, and that it doesn't violate anyone else's rights.

10. Suspension and termination

LibertyBid may suspend or terminate your account for violating these Terms, abusing the Platform, or engaging in fraudulent or harmful conduct. You may stop using the Platform at any time. LibertyBid does not currently offer a self-service "delete my account" feature — to request account closure or deletion of your personal data, contact legal@libertybid.com.

11. Disclaimers and limitation of liability

The Platform is provided "as is," without warranties of any kind. LibertyBid does not guarantee the quality, safety, timeliness, or legality of any work performed by a Business, or that a Customer will pay for work performed. LibertyBid is not responsible for disputes, damages, or losses arising from an agreement or interaction between a Customer and a Business — those are between the two of you. To the fullest extent permitted by law, LibertyBid's liability to you for any claim related to the Platform is limited to the amount you paid LibertyBid, if any, in the twelve months before the claim arose.

12. Governing law and disputes

These Terms are governed by the laws of [Governing law/jurisdiction not yet chosen], without regard to conflict-of-law principles. [This section is a placeholder — the governing jurisdiction and dispute-resolution process (e.g. arbitration, small claims, venue) have not yet been decided and should be finalized with legal counsel.]

13. Changes to these Terms

LibertyBid may update these Terms from time to time. Material changes will be reflected by updating the "Last updated" date above. Continuing to use the Platform after a change takes effect means you accept the updated Terms.
